Heard Ms. S. Rahman, learned counsel for the petitioner and Mr. D. Das, learned Additional Public Prosecutor. By this application filed under Section 5 of the Limitation Act, the applicant has prayed for condoning the delay of 116 days in preferring the connected Criminal Appeal against the Judgment and Order, dated 12.04.2024 passed by the learned Sessions Judge, Karimganj in Special NDPS Case No. 171/2022 whereby the accused was convicted and sentenced to undergo rigorous imprisonment for 5 years with fine. The grounds of delay as stated in the petition are found to be satisfactory. Learned Additional Public Prosecutor has made no objection in the matter of condoning the delay. Accordingly, the delay of 116 days is hereby condoned. This interlocutory application accordingly stands disposed of.
