ORDER
06.11.2024
Heard Mr. M A I Hussain, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Suban Chandra Baro, praying for release on bail, who was arrested in connection with Goreswar P.S. Case No. 51/2024. Page No.# 2/2 After two years of marriage, a 27 years old woman had committed suicide by consuming poison. She left a suicide note stating that the present petitioner along with others had caused physical and mental torture upon her. The Case Diary reveals that the husband of the deceased woman wanted to marry another woman and on that issue, they had quarrels. Her husband, the present petitioner and other family members put pressure upon the deceased to go for divorce so that her husband can marry the other woman. I have considered the submissions made by the learned counsel of both sides. The petitioner has already undergone 45 days in custody. This court is of the opinion that under the given circumstances of the case, the petitioner no longer deserves to be detained in custody for further period of time. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Suban Chandra Baro, who was arrested in connection with Goreswar P.S. Case No. 51/2024, shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Baksa. The bail application is disposed of. Return the Case Diary.
