It is submitted by the learned counsel for the petitioner that the petitioner has been languishing in jail hazot for the last 48 days. It is also submitted that Section 307 IPC is not attracted in this case as the injury sustained by the victim is simple in nature. It is further submitted Section 384 IPC is also not attracted in this case as there is no allegation that the petitioner has committed extortion in any manner to the victim and the other sections, as mentioned in the FIR, are bailable in nature. Considering the background of the case as well as nature of the offence, the prayer of the petitioner may be considered. On the other hand, Ms. Bora, learned Additional Public Prosecutor for the State has submitted that case diary has been received without injury report.
