Meser Ali v. The State of Assam

Heard Mr. D. Bora, learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor appearing for the State. This is an application filed under Section 438 Cr.P.C., praying for Page No.# 2/2 pre-arrest bail by the petitioner, namely, Meser Ali, in connection with Chapar P.S. Case No. 200/2023, registered under Section 9/10/11(1) of Prohibition of Child Marriage Act r/w Section 6/17 of POCSO Act. Mr. Goswami, learned Additional Public Prosecutor submits that in this case, charge-sheet has already been submitted vide C.S. No. 203/23 dated 28.10.2023. It is also submitted that interim protection has already been granted to the petitioner by this Court vide order dated 11.10.2023. In view of above, the present petition is disposed of with a direction to the petitioner to appear before the learned court below within 10 days from today and if any bail application is filed, the same will be considered by the learned trial court in accordance with law. Till such appearance, the interim protection granted to the petitioners shall remain in force.
