It is submitted by the learned counsel for the petitioners that when the FIR was lodged, the victim is a major girl aged about 19 years. It is also submitted that on 16.05.2022, the petitioner No. 1 got married to the victim girl after getting majority so the provision of POCSO Act does not attract here in this case. The petitioner No. 2 who is the father of the petitioner No.1. The learned counsel for the petitioners has submitted that they have been detained in custody since 04.10.2023. Considering the background of the case, bail may be granted to the petitioners. In response, Mr. Goswami, learned Additional Public Prosecutor for the State has submitted that he has no objection if the prayer of the petitioners be granted after considering the age of the victim girl. I have considered the submissions made by the learned counsel for the parties. I have also perused the documents available on record. It appears that the date of the birth of the victim is 11.02.2004 and got married to the petitioner No. 1 on 16.05.2022. It transpires that the victim was about 18 years of age at the time of marriage with the petitioner No. 1.
