¶1Heard Mr. AFNU Mollah, learned counsel for the petitioners. Also heard Mr. B. Sharma, learned Additional Public Prosecutor, appearing for the State of Assam. Though the case diary was called for, however, learned Additional Public Prosecutor, has submitted that in the meanwhile charge sheet has already been laid bearing C.S. No. 191/2023 dated 11.05.2023.

¶2It appears from record, that by order dated 17.10.2023, the petitioner Nos. 2 and 3, namely, Samad Ali and Rafikul Islam @ Rokibul Sk were allowed to go on interim anticipatory bail by this court and it is submitted by the learned counsel for the petitioners that the above named petitioners have appeared before the Investigating Officer and have co operated in the investigation.

¶3In view of the submissions made by the learned counsel for the petitioners, the interim bail granted to the above named petitioners, by order dated 17.10.2023, is hereby made absolute, with condition No. (ii), attached to the said order remaining intact.

¶4As regards petitioner No. 1, no order under Section 438 is passed. He may appear before the trial court and may seek any relief to which he is entitled to before the said court.

¶5With the above observations, this anticipatory bail application is disposed of.
