Heard Mr. N. Mahajan, learned counsel appearing for the applicant as well as Mr. R.R. Kaushik, learned Additional Public Prosecutor for the State of Assam/respondent No. 1. This is an application u/s 430(3) of the BNSS, 2023 praying for suspension of sentence passed against the applicant vide the impugned judgment dated 05.11.2024 by the learned Sessions Judge, Kamrup, Amingaon in Sessions Case No. 57/2016 and for allowing the present petitioner to go on bail. I have gone through the record as well as the impugned judgment. The sentence imposed by the petitioner on 05.11.2024 by the learned Sessions Judge, Kamrup, Amingaon in Sessions Case No. 57/2016 shall remain stayed till disposal of the connected appeal. The applicant is allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Sessions Judge, Kamrup, Amingaon in respect of Sessions Case No. 57/2016.
