Md. Nosrul Haque Choudhury v. The State of Assam and 3 Ors

Disposed Of
Court

Case no.
WP(C) 6398/2023

Judgment

ORDER Date : 08/01/2024

Heard Mr. I. Alam, learned counsel for the writ petitioner. Also heard Mr. D. Bora, learned Government Advocate, Assam, appearing for the State. The grievance of the petitioner is that his application for appointment on compassionate ground was never considered by the authorities despite the earlier orders passed by this Court. It appears that the father of the petitioner had died in harness on 12/06/2000. Thereafter, the petitioner had submitted an application seeking appointment on compassionate ground. Based on the written instruction obtained by the learned Government Advocate, Mr. Bora submits that the case of the petitioner was considered way back in the year 2012 and was rejected. Mr. Alam submit that his client was not aware of the said development, as a result of which, the instant writ petition has been filed. The father of the petitioner had died more than 23 years back. Therefore, the question of issuing a Mandamus for considering his application for appointment on compassionate ground, cannot arise at this distant point of time. As such, this writ petition stands disposed of as not maintainable.
