2024 Heard Mr. M. Talukdar, learned counsel for the applicants/ claimants and Ms. M. Choudhury, learned counsel for the opposite party/ Insurance Company. By filing this application, the applicants have prayed for withdrawal of 50% of the total awarded amount in pursuant to the order dated 09.10.2023, passed in I.A. (Civil) No. 1972/2023, arising out of MAC Appeal No. 269/2023. The learned counsel for applicants has submitted that the appellant/ Insurance Company has already deposited an amount of Rs. 8,38,500/ (Rupees eight lakhs thirty eight thousand five hundred only) which is 50% of the total awarded amount before the Registry of this Court in pursuant to the order dated 09.10.2023, passed in I.A. (Civil) No. 1972/2023, arising out of MAC Appeal No. 269/2023 and the applicants have prayed for to withdraw the said deposited amount of Rs. 8,38,500/ (Rupees eight lakhs thirty eight thousand five hundred only). The learned counsel for the appellant/ Insurance Company has no objection to withdraw the said deposited amount. The applicant No. 1 is directed to withdraw the said 50% of the total awarded amount from the Registry after proper verification and identification by the concerned advocate.
