12.02.2024
Heard the learned counsel Mr. M.H. Rajbarbhuiyan appearing for the applicants. Also heard Ms. R. Begum, learned counsel representing respondent no.1. Mrs. L. Sarma, learned counsel appears for respondent no.2, the Insurance Company. This is an application under Section 5 of the Limitation Act praying for condonation of 495 days of delay in preferring the connected appeal. Mr. Rajbarbhuiyan submits that the applicants filed a review petition against the judgment of the Tribunal and that is the reason why the delay took place. The learned counsels representing the opposite parties/respondents have fairly submitted that they have no objection if the delay is condoned. I have gone through the application and found that the delay has been sufficiently explained. Therefore, the delay stands condoned. The connected MAC Appeal shall be registered and listed for Admission hearing. The Interlocutory Application is disposed of. Page No.# 3/3 Copies of the memo of appeal shall be supplied to the learned counsels representing the opposite parties/respondents.
