Heard the learned counsel Mr. P.J. Saikia appearing for the petitioners. Also heard Mr. P. Borthakur, the learned Addl. Public Prosecutor, Assam. This is an application under Section 438 of the CrPC filed by the petitioners, namely- (1) Sri Ashok Deka, (2) Sri Prasanta Deka and (3) Sri Budu Ram Deka, praying for anticipatory bail in connection with Jagiroad P.S. Case No.298/2023, registered under Sections 120-B/302 of the Indian Penal Code read with Section 34 of the said Code. Pursuant to an interim order granted by this Court, the petitioners have appeared before the Investigating Officer and have co-operated with the police investigation. Since the petitioners have co-operated with the police investigation, they do not deserve to be detained in custody. Accordingly, their pre-arrest bail application is allowed. Interim bail granted on 18.10.2023 in favour of the above named petitioners is made absolute. However, the petitioners are directed to co-operate with the police investigation as and when required.
