Kurban Ali v. The State of Assam

Heard Mr. A M Ahmed, learned counsel for the petitioner and D Das, learned Additional Public Prosecutor, Assam. By filing this application under Section 483 of the BNSS, 2023 the petitioner, namely, Kurban Ali, has prayed for release on bail, who was arrested in connection with North Lakhimpur P.S. Case No. 309/2024. Page No.# 2/2 The informant by filing an FIR alleged that he had received a phone call from unknown persons informing that if he gave Rs.1.5 Lakh then he would be given fake Indian currency of an amount of Rs. 8 Lakhs. Thereafter, on 11.10.2024, the informant handed over Rs.1.5 Lakh and took fake currency from the person concerned. But he was not satisfied with the person who had received his money in lieu of fake currency notes, as promised earlier. Therefore, he had lodged the FIR before the Police. I have considered the submissions made by the learned counsel of both sides. The informant seems to have tried to purchase fake currency notes by paying genuine currency notes. Under the given circumstances, the petitioner does not deserve to be detained in custody for further period of time. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Kurban Ali, who was arrested in connection with North Lakhimpur P.S. Case No. 309/2024, shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Lakhimpur. The bail application is disposed of.
