ORDER

Heard Mr. H.R.A Choudhury, learned senior counsel for the petitioner, assisted by Mr. A. T. Sarkar, Advocate and Mr. D Das, learned Additional Public Prosecutor, Assam. By filing this application under Section 483 of the BNSS, 2023 the petitioner, namely, Mukhlesur Rahman @ Taju, has prayed for release on bail, who was arrested in connection with Gossaigaon P.S. Case No. 167/2024. It is alleged in the FIR that one 32 years old deaf and dumb woman was raped by two unidentified persons. Page No.# 2/2 The Medical Report shows that the victim woman is a mother of a child. Mr. Choudhury has submitted that marriage ceremony of the sister of the present petitioner was solemnised. The so-called victim woman was engaged in his house as a maid for that day only According to Mr. Choudhury, the petitioner has been unnecessarily involved in the present case. I have considered the submissions made by the learned counsel of both sides. Under the given circumstances, this court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Mukhlesur Rahman @ Taju, who was arrested in connection with Gossaigaon P.S. Case No. 167/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned SDJM, Gossaigaon. The bail application is disposed of.
