Judgment

ORDER Date : 27/11/2024

Heard Mr. S. Ali, learned counsel for the writ petitioner. Perused the averments made in the writ petition. By filing this writ petition, the petitioner, who was appointed in the post of Driver in the office of the District Commissioner, Baksa, has approached this Court seeking a Writ of Mandamus for release of his arrear salary. Mr. S. Ali, learned counsel for the writ petitioner submits that the petitioner had submitted a representation dated 11/06/2020 ventilating his grievance in the matter. Notwithstanding the receipt of the same, no action has been taken in his case. Hence, this writ petition. Mr. P. Nayak, learned Standing Counsel, GAD and Finance Department, Assam, appearing for the respondent nos. 1 & 2 and Mr. C.K.S. Baruah, learned Government Advocate, Assam, representing the respondent no. 3, submit that since the representation of the petitioner has not been disposed of till date, this writ petition be disposed of with a direction upon the concerned authority to consider the grievance of the petitioner. The petitioner's counsel is also agreeable to the said proposition. In view of the above, this writ petition is disposed of at the stage of motion hearing by granting 3 (three) weeks time to the petitioner to submit a fresh representation ventilating his grievance. Page No.# 3/3 If such representation is submitted within three weeks from today by enclosing a certified copy of this order, the same be considered on merit and disposed of by a reasoned order within six weeks thereafter. Whatever be the outcome of the process, the same be intimated to the petitioner in writing. If the petitioner continues to remain aggrieved even thereafter, it would be open for him to approach this Court once again by filing appropriate petition. With the above observation, the writ petition stands disposed of.
