Heard Mr. A K Ahmed, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Rashmi Parbin @ Shamim Ali, aged about 27 years, praying for release on bail, who was arrested in connection with Chandmari P.S. Case No. 159/2024. Page No.# 2/2 The petitioner fell love with another 15 (fifteen) years old girl and the said minor girl came to Guwahati in search of the petitioner and accordingly, they met each other and stayed together. The mother of the minor girl was against such a relationship. Therefore, she lodged an FIR before the Police alleging that her minor daughter was kidnapped by the present petitioner. Police filed the charge sheet in this case. The learned Additional Public Prosecutor has submitted that the petitioner has already spent 155 days in judicial custody. The trial has not yet been concluded. I have considered the submissions made by the learned counsel of both sides. Considering the long period of detention, the prayer of the petitioner for bail is allowed. Accordingly, it is directed that the petitioner Rashmi Parbin @ Shamim Ali, who was arrested in connection with Chandmari P.S. Case No. 159/2024 shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Additional Sessions (FTC) No. 4, Kamrup (M), Guwahati. The bail application is disposed of.
