¶1Heard Ms. B. Goyal, learned counsel for the petitioner Rupsing Pegu.

¶2The petitioner has filed this application under Section 483 of the Page No.# 2/2 Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since 22.08.2024 in connection with Dispur P.S. Case No. 841/2024 under Sections 103(1) of the BNS.

¶3Heard Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The FIR unfolds that on 08.08.2024, the informant was apprised that her daughter has passed away in her rented house at House No.17, Sewali Path, Hengrabari, Guwahati. Investigation commenced and the petitioner was arrested in connection with this case.

¶5I have considered the submissions at the Bar.

¶6It is submitted that the petitioner has been behind bars since

22.08.2024. It is also submitted that charge-sheet has not been laid against the petitioner and the statutory period of 90 days has elapsed.

¶7I have also considered the submission relating to length of detention of the petitioner.

¶8Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail of Rs. 30,000/- with a suitable surrey of like amount to the satisfaction of the learned CJM, Kamrup, (M).

¶9In terms of the above observation, bail application stands disposed of.
