Heard Mr. M. A. Mondal, learned counsel for the petitioners. Also heard Mr. B. Page No.# 2/2 Sarma, learned Additional Public Prosecutor for the State of Assam. By this application under Section 438 of Cr.P.C. the petitioner, namely, Abdur Rashid Mondal @ Rashid Mondal @ Abdur Rashid has prayed for granting pre arrest bail who is apprehending arrest in connection with Chapar P.S. Case No. 199/2023 under Sections 9/10/11(i) of PMC Act read with Section 6/17 of POCSO Act. It is submitted by the learned Additional Public Prosecutor for the State of Assam that the charge sheet being CS No. 224/2023 dated 31.10.2023 has already been filed by the Investigating Officer after completion of the investigation. In view of the aforesaid, it is provided that the interim order dated 10.11.2023 passed by this Court in respect of petitioner namely, Abdur Rashid Mondal @ Rashid Mondal @ Abdur Rashid, shall remain in force till the petitioner appear before the learned trial Court on receipt of summon and seek regular bail. In the event of such appearance seeking regular bail, the same be considered as per law. Accordingly, this bail application stands disposed of. JUDGE Comparing Assistant
