Heard Mr. R Ali, learned counsel for the petitioner. Also heard Mr. RR Kaushik, learned Additional Public Prosecutor, Assam appearing for the State respondents. Page No.# 2/2 This is an application under Section 438 Cr.P.C., praying for pre-arrest bail of the petitioner, namely, Md.Zinnatul Islam@ Zinnatul Islam, in connection with Khetri P.S. Case No. 158/2023, registered under Sections 379/411/34 IPC read with Section 11 of the Prevention of Cruelty to Animals Act, read with Section 7/13 of the Assam Cattle Preservation Act, 2021. Case diary is received. The Additional Public Prosecutor, Assam has submitted that as per direction of this Court, the petitioner has appeared before the Investigating Police Officer and got his statement recorded. Further there is no allegation against the petitioner that during the intervening period the petitioner had misused the liberty granted to him. Considering the above and taking note of the fact that the learned Additional Public Prosecutor has no objection to the prayer for bail of the petitioner and further there is no reflection on the case diary that the petitioner had in any manner misused the liberty granted to him during the bail period, the interim bail granted to the petitioner on 22.11.2023 is hereby made absolute on the same terms and conditions.
