Heard Mr. N. Ahmed, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.

This is an application under Section 438 of the Code of Criminal Procedure, for grant of pre-arrest bail to the accused petitioner, who is apprehending arrest in connection with Sorbhog P.S. Case No. 107/2023, under Sections 342/394 of the Indian Penal Code, added Section 395/412/413 of the Indian Penal Code.

Mr. P. Borthakur, learned Additional Public Prosecutor, submits that though the case was listed today for production of the Case Diary before this Court, but the case has already been Charge-Sheeted, vide Charge-Sheet No. 110/2023, dated 31.12.2023.

However, it is submitted by learned counsel for the petitioner as well as the learned Additional Public Prosecutor that the case is not Charge-Sheeted against the present petitioner-Nurul Islam.

In view of the matter, since there is no apprehension of arrest and this petition becomes infructuous and accordingly, the same stands closed.
