Heard Mr. S Paul, learned counsel for the petitioner and Mr. D Das, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 by the petitioner, namely, Jomor Ali @ Jomur Ali @ Jamur Ali, praying for pre-arrest bail in connection with PRC Case No. 76/2024 pending in the court of the learned SDJM, Dhubri. Page No.# 2/2 I have also gone through the FIR. It is submitted that the petitioner is ready to appear before the court and face the trial. The petitioner submits that the offence alleged against him are Sessions triable and the learned SDJM does not have the jurisdiction to entertain the bail application. I have considered the submission made by the learned counsel of both sides. Since the petitioner is interested to face the trial, he deserves to be given the opportunity to release on bail. Therefore, it is hereby directed that the petitioner Jomor Ali @ Jomur Ali @ Jamur Ali, shall appear before the learned SDJM, Dhubri within next 10 (ten) days in connection with PRC Case No. 76/2024 and on his appearance, he shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned SDJM, Dhubri.

The bail application is disposed of.
