Judgment

ORDER Date : 23-01-2024 Heard Mr. B.D. Das, learned senior counsel assisted by Mr. K. Kalita, learned counsel for the petitioner. Also heard Mr. B. Choudhury, learned Standing counsel, ONGC appearing for respondent Nos. 1 to 5. The case projected by the learned senior counsel for the petitioner is that the petitioner is a participant in the E-tender No. R16KC23008 dated 22.05.2023 issued by the respondent for Charter Hiring of Services for 36 Nos. of Chemical Dosing System for Surface Team Nazira, Assam Asset for a period of 3 years 2023-2026). However, before the stage of technical evaluation, the petitioner had lodged complaints dated 12.07.2023, 27.10.2023 and 09.11.2023 before the Chief Vigilance Officer, New Delhi through online portal. Basing on the said complaint, the vigilance enquiry has been registered and enquiry initiated. The limited grievance of the petitioner at the moment is that the complaint for vigilance enquiry has not yet been disposed of and as such the said enquiry proceeding may be expedited and disposed of as early as possible by giving an opportunity of hearing to the petitioner and the other concerned parties. The learned senior counsel further informed this Court that during the pendency of this writ petition, now by notification of award dated 13.12.2023, the petitioner has been offered a contract with award for Charter Hiring of Services for 12 Nos. (10 nos. with DG sets & 02 nos. without DG sets) of Chemical Dosing System for ST Nazira, Assam Asset for a Period of 03 years (OLA No. 9010037549) against ONGC e-tender no. R16KC23008, and the petitioner has accepted the said contract vide its letter dated 08.01.2024 unconditionally. In view of above and as agreed upon by the learned counsel for the parties, this writ petition is disposed of by directing the respondent authority to complete the vigilance enquiry expeditiously within a period of 3 (three) months from today and pass appropriate order after hearing the petitioner and the other concerned parties within the said period of 3 (three) months. With the above, this writ petition stands disposed of.
