Dhanakanwa Lakra @ Pascal Urang and 5 Ors v. The State of Assam

ORDER Date : 05-06-2024 Heard Ms. N Deka learned counsel for the petitioners. Also heard Mr. B Sarma learned Addl. PP, Assam. By this application under Section 438 Cr.P.C., the petitioners, namely, 1. Sri Dhanakanwa Lakra @ Pascal, 2. Sri Alius Urang, 3. Sri Silbanus Urang, 4. Sri Angalu Urang, 5. Sri Judge Lakra @ George Lakra & 6. Sri Arun Urang have prayed for pre arrest bail who are apprehending Page No.# 3/3 arrest in connection with Tongana PS Case No.20/2023 corresponding to GR Case No.1304/2023 under sections 429/34 IPC read with section 11 of Prevention of Cruelty to Animal Act and section 13 of Assam Cattle Preservation Act, 2021. Case diary called for is received and perused. This court vide order dated 20.11.2023 granted interim bail to the petitioners while calling for the case diary. The case diary is received. Perused the same. From the materials available on record, it is seen that the petitioners have fully cooperated with the investigation and their statements were also recorded. The materials so far collected by the investigating officer against the above named petitioners, in the considered opinion of this court, do no warrant custodial interrogation of the petitioners in this case inasmuch as the petitioners had co-operated with the investigating authority and there is no allegation that they tried to hamper and tamper with the investigation. Therefore, in the totality of the matter, the interim protection granted under order dated 20.11.2023 is made absolute with the same terms and conditions. The pre-arrest bail application stands disposed off. Send back the case diary.
