¶2This an application u/s 483 of the BNSS, 2023, whereby the petitioner, Faijuddin Haque @ Faijuddin Hoque has prayed for releasing him on bail, after he was arrested in connection with Garchuk P.S. Case No. 203/2024 (corresponding to GR No.3969).

¶3The allegation brought against the petitioner is that he had kidnapped a 16 year old girl. Later on the girl was recovered and she has made a statement before the learned Magistrate that she was in love with the petitioner and she on her own volition went with the petitioner to marry him.

¶4I have considered the submissions made by the learned counsels of both sides.

¶5Under the given circumstances of the case, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed.

¶6It is hereby directed that the petitioner, Faijuddin Haque @ Faijuddin Hoque, who was arrested in connection with Garchuk P.S. Case No. 203/2024, shall be released on bail of Rs. 20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati.

¶7The bail application is disposed of. The CD shall be returned.
