Gulbahar Ali @ Rahul Sk v. The State of Assam

Heard Mr. A.Z.Ahmed, learned Counsel for the petitioners and Mr. B.Sharma, learned Addl.P.P. for the State respondent. Learned Counsel for the petitioner has submitted some documents from which it reveals that I.O. Riturparna Bania was entrusted to investigate the present case. It further shows that two accused persons namely, Nazrul Islam and Ms. Gulvan Nesa were arrested in connection with this case on 24.08.2023. Subsequently, Sukchar PS Case No.15/2015 is transferred to the court of learned CJM, Tura, Meghalaya on 02.07.2024. Learned Addl.P.P. submits that the present case is transferred to the court of learned CJM, Tura, Meghalaya as per information of the I.O. and as such, this Court has no jurisdiction to entertain the matter. Having heard learned counsel for the parties and on perusal of the documents, it reveals that the present case is already transferred to CJM, Tura, Meghalaya Page No.# 3/3 and as such, the pre-arrest bail application stands disposed of with a direction to the petitioner to approach before the proper forum.
