¶1Heard Ms. S.E. Ahmed, learned counsel appearing for the petitioner as well as Mr. D.P. Goswami, learned Additional Public Prosecutor for the State respondent. Page No.# 2/2

¶2The petitioner, namely, Arfan Ali, has filed this application under Section 438 Cr.P.C with prayer for pre-arrest bail as he is apprehending arrest in connection with Satgaon P.S. Case No. 205/2023, registered under Section 22 (a) of the NDPS Act.

¶3I have considered the submissions at the Bar.

¶4It is submitted at the Bar that the petitioner is apprehended with a very small quantity of ganja weighing only up to 238 grms. It is submitted that the petitioner is not a drug peddler.

¶5It is submitted on behalf of the petitioner that he is not involved in drug trafficking. The petitioner is willing to co-operate with the investigation as well as with the trial. The petitioner is a local resident.

¶6Considering the submissions at the Bar and after perusal of the case diary, I deem it proper to direct the petitioner to appear before the learned trial Court and apply for bail, which may be considered by the Court as per law.

¶7With the above observation and direction, this petition stands disposed of. Send back the case diary.
