Heard Mr. Z Hussain, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023, the petitioner Sri Jintumoni Page No.# 2/2 Koch has prayed for release on bail, who was arrested in connection with Rowta P.S. Case No. 131/2024. One girl has alleged that for the last 3 (three) years she was maintaining relationship with the present petitioner. They had regular physical relationship. On one occasion, the petitioner took the girl to his house and put vermillion on her forehead and since then, she has been residing with him. Even then, she continued to put pressure upon the petitioner to solemnise a social marriage, which was not done by the petitioner. Therefore, the girl alleged that the petitioner cheated her. I have considered the submissions made by the learned counsel of both sides. The petitioner has already completed 61 days in judicial custody. This court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time under the given circumstances. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Sri Jintumoni Koch, who was arrested in connection with Rowta P.S. Case No. 131/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Udalguri. Bail application is disposed of.
