Sri Mriganka Gogoi v. The State of Assam

Heard Mr. S R Gogoi, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023, the petitioner, namely, Sri Mriganka Gogoi, who was arrested in connection with Dhakuakhana P.S. Case No. 85/2024, has prayed for release on bail. The petitioner herein is an 18 (eighteen) years old person. Another 18 (eighteen) years old Page No.# 2/2 girl has lodged an FIR before Police alleging that on 20.10.2024, at about 6.30 PM, the present petitioner took her to the house of another person situated at Narayanpur Chapori, where they had physical relationship. But, thereafter the petitioner allegedly left her alone there and the girl had to call her parents to take her home. I have considered the submissions made by the learned counsel of both sides. The petitioner has already undergone 51 (fifty one) days in judicial custody. Therefore, at this stage, this court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Sri Mriganka Gogoi, who was arrested in connection with Dhakuakhana P.S. Case No. 85/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned SDJM, Dhakuakhana. The bail application is disposed of.
