Mr. A. Paul, the learned counsel appearing on behalf of the petitioner submits that in view of the judgment of the Supreme Court in the Case of DSR Steel (P) Limited vs. State of Rajasthan & Others, reported in (2012) 6 SCC 782, he would not like to press the instant petition taking into account that the petitioner herein ought to challenge the order dated 18.08.2022 passed in Misc.(J) Case No.172/2022 arising out of Title Appeal No.11/2019. The learned counsel for the petitioner however submits that the withdrawal of the instant petition should not preclude the petitioner to approach this Court if the petitioner is aggrieved against the order dated

18.08.2022 passed in Misc.(J) Case No.172/2022.

¶2Taking into account the above, the instant petition stands closed on withdrawal.

¶3However, liberty is granted to the petitioner to avail appropriate remedies if so permissible under law.
