Malik Doom and 4 Ors v. The State of Assam

O R D E R

03.05.2024 Heard learned counsel for the parties. This is an application filed under Section 438 Cr.P.C. praying for granting pre-arrest bail to the petitioners, namely, 1. Sri Malik Doom, 2. Sri Gotum Doom, 3. Sri Karan Doom, 4. Sri Munna Doom and 5. Sri Sunil Doom in connection with Duliajan Police Station Case No. 168/2023 under Section 341/325/34/506 IPC with added Section 326 of IPC. This court under its order dated 30.11.2023 granted interim protection to the petitioner Nos. 2 to 5. Subsequently, this court under its order dated 16.02.2024 made the interim order dated 30.11.2023 passed in favour of the petitioner Nos. 2 to 5 absolute. Subsequently, by another order dated 05.04.2024, the petitioner No. 1, Sri Malik Doom was also granted interim protection. Statements of the witnesses as well as victim have been recorded. The injury report has also been collected. Considering the matter in its entirety more particularly claim and counter claim between the parties and also considering the fact that the petitioner No. 1, Malik Doom has co-operated with the Investigating Officer, this court is of the view that the custodial interrogation of the petitioner No. 1, namely, Sri Malik Doom may not be Page No.# 3/3 necessary. Accordingly, the earlier interim order dated 05.04.2024 passed in favour of the petitioner No. 1 is made hereby absolute on the same terms and conditions. Application stands disposed of.
