Mr. A.R. Bhuyan, learned counsel for the petitioner submits that the submissions made by him on the last date that the Scheme, which is under challenge in the present proceedings has been interfered with, was on misconception. Actually, it is a Clause of the said Scheme which was interfered with and a writ appeal in this regard is pending before the Division Bench of this Court. He submits that he has instruction from the petitioner not to press the present petition with liberty to re-file, if the occasion so arises. The above prayer is accepted. This writ petition stands dismissed on withdrawal with liberty to the petitioner to institute fresh proceedings, if the occasion so arises in future.
