Judgment

ORDER Date : 10-01-2024 Heard Ms. P. Agarwal, learned counsel for the petitioner. Also heard Mr. P.J. Phukan, learned standing counsel, Gauhati University, representing all the respondents. The petitioner, by way of instituting the present proceeding, has raised a grievance with regard to denial to her of an admission into a Ph.D. Course Page No.# 2/3 inspite of being selected for the same. It was the contention of the authorities of the Gauhati University that the topic as chosen by the petitioner is a highly specialized one for which there was no person who could be appointed as a Supervisor in the Gauhati University. On a request made by this Court, Mr. Phukan was required to explore as to whether a Supervisor for the petitioner's topic can be found out from any of the affiliated Colleges of the Gauhati University and/or from any other Universities. Today, Mr. Phukan has placed on record an instructions dated

09.01.2024 (wrongly written as 09.01.2023) issued by the Academic Registrar, Gauhati University, wherein it has been stated that Dr. Bhaskar Jyoti Hazarika, Department of Physics of Pandu College, has been chosen to be the Supervisor under whom the petitioner would carry out her research leading to her Ph.D. Degree. The petitioner, within a period of 7(seven) days from today along with a certified copy of this order, shall approach the said Supervisor, namely, Dr. Bhaskar Jyoti Hazarika, for taking the matter forward. In the event it is found that Dr. Bhaskar Jyoti Hazarika is not in a position to take up the Supervisor-ship for the petitioner, the petitioner shall immediately bring the matter to the notice of the Vice Chancellor, Gauhati University, who shall, within a period of 15(fifteen) days therefrom, make alternative arrangement without fail so as to provide the petitioner a Supervisor and permit her to carry out her research works leading to the Ph.D. Degree. It is expected that the Vice Chancellor, Gauhati University shall take all requisite steps to provide an environment for the petitioner to pursue her Ph.D. research works. With the above observations, the writ petition stands disposed of. Page No.# 3/3 The instructions dated 09.01.2024, as produced by Mr. P.J. Phukan, learned standing counsel, Gauhati University, is kept on record and marked as "X". J U D G E Comparing Assistant
