Delowar Hussain v. Bajaj Allianz General Insurance Co Ltd

The appellant, namely, Delowar Hussain is present along with Mr. M.M. Zaman, learned counsel. Mr. Nayan Choudhury, Hub In-Charge, Appeal and Specialized Claims, Bajaj Allianz General Insurance Company Ltd. is also present.

¶2Both the parties have jointly submitted that an award of Rs.2,17,902/- (Rupees two lakh seventeen thousand nine hundred two only) was passed vide order and award dated 02.02.2023, passed by the learned Member, MACT, Goalpara in MAC Case No.293/2016. After negotiated settlement, the parties have agreed that in addition to the award, a further sum of Rs.2,80,000/- (Rupees two lakh eighty thousand only) would be the full and final settlement of all the claims of the appellant.

¶3Accordingly, the matter is settled on compromise in terms of the pre-settlement/compromise slip for the National Lok Adalat, which is made as a part of record.

¶4Both the parties shall put their signature in the pre-settlement/compromise slip as token of acceptance for the settlement.

¶2Accordingly, the Bajaj Allianz General Insurance Company Ltd. shall Page No.# 3/3 deposit the additional amount of Rs.2,80,000/- (Rupees two lakh eighty thousand only) in favour of the appellant/claimant before the MACT, Goalpara within a period of 30 (thirty) days from the date of the this settlement order, failing which the amount shall carry interest @ 9% per annum till the date of deposit.

¶5On such deposit being made, the MACT, Goalpara shall disburse the said amount in favour of the claimants/appellants on satisfaction of his identity.

¶6On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the respondents.
