Munna Ali v. The State of Assam

ORDER Date : 18.03.2024 Heard Ms. S. Parveen, learned counsel appearing for the Petitioner. Also heard Mr. R.J. Baruah, the learned Additional P.P. for the State of Assam. This is an application under Section 438 of the Cr.P.C. in respect of Page No.# 2/2 Goalpara P.S. Case No.100/2023 under Sections 120(B)/408/420/34 of the Indian Penal Code. A person called Shukur Ali working in a Company "Instakart Services Pvt. Ltd" lodged an FIR before the police alleging that one of his colleague Naushad Khan had misappropriated a large amount of money belonging to the Company. The Petitioner is one of the employees of the aforesaid "Instakart Services Pvt. Ltd". I have considered the submissions made by the learned counsel for both sides. The case diary does not reveal sufficient incriminating materials against the present petitioner. Moreover, pursuant to the interim order granted in favour of the Petitioner, he had appeared before the Investigating Officer and cooperated with the investigation. For the aforesaid reasons, the bail application of the petitioner Munna Ali is allowed. The interim bail granted to the petitioner by this Court on

04.12.2023 is hereby made absolute. The bail application stands disposed off accordingly. The CD shall returned.
