Goswami, learned Junior Government Advocate, Assam for the opposite party no. 6. None has appeared for the opposite part nos. 1, 2 & 5 on call.

¶2The applicant, who is the writ petitioner in the connected writ petition, W.P.[C[] no. 1961/2022 has preferred the instant interlocutory application in view of the order dated Page No. 4/5

28.03.2023 passed by the Lawazima Court in the said writ petition.

¶3In the order dated 28.03.2023, the Lawazima Court had observed that in so far as the notice sent to the opposite party no. 7 herein, that is, the respondent no. 7 in the connected writ petition is concerned, the said notice had returned unserved with a new address written on the envelope of the returned unserved notice to the following effect :- "Suryabanshi Choudhury, Hindi Bhawan, Nehru Park, Jorhat [Assam] 785001."

¶4In the instant interlocutory application, the petitioner has averred that apart from the afore-mentioned address, two new addresses of the opposite party no. 7 herein, that is, the respondent no. 7 in the connected writ petition are found as under :-

"1. Sri Suryavanshi Chowdhury Son of Sushit Chowdhury C/o Smti Minoti Sharma [Central Hindi Directorate, Guwahati], Das Enterprise, Jaya Nagar, Khanapara, Guwahati-781022, Kamrup [M], Assam

¶2Sri Suryavanshi Chowdhury Son of late Award Kishore Chowdhury, R/o Village and P.O. Gharwara, Pin – 843315, District – Sitamari, Bihar."

¶5The instant interlocutory application has been preferred by the applicant-writ petitioner with a prayer to permit the applicant-writ petitioner to take steps for service of notice upon the said opposite party no. 7 herein, that is, the respondent no. 7 in the connected writ petition in the afore-mentioned three addresses by registered post with A/D.

¶6The prayer made in this interlocutory application is allowed. Page No. 5/5

¶7The petitioner shall take steps for service of notice upon the opposite party no. 7 herein, that is, the respondent no. 7 in the connected writ petition by registered post with A/D within 3 [three] working days from today in the afore-mentioned three addresses.

¶8The interlocutory application stands accordingly disposed of.

¶9The office to record the service status of the notice sent to the opposite party no. 7 herein, that is, the respondent no. 7 in the writ petition, W.P.[C] no. 1961/2022 in the note sheets of the records of the connected writ petition, W.P.[C] no. 1961/2022.
