Heard Mr. A. Ali, learned counsel for the applicants and Mr. B. Sharma, learned Addl. P.P. for the State respondent.

¶2Apprehending arrest in connection with Goalpara Police Station of any case, this application under Section 438 of the Code of Criminal Procedure, 1973, is preferred by applicants namely, Ibrahim Ali; Rofiqul Islam; Rashidul Islam; and Osman Goni for grant of pre-arrest bail.

¶3Pursuant to the order of this Court dated 14.12.2023, the learned Addl. P.P. received a report from the Officer In-Charge of Goalpara PS and placed the same before this Court and submits that the Officer In-Charge has confirmed that no FIR is pending in Goalpara PS, against the present applicants.

¶4In view of above, this application becomes infructuous and accordingly, the same stands dismissed.

¶5The report submitted by the learned Addl. P.P., shall be kept as a record of this application.
