Pranab Goswami and Anr v. The State of Assam

ORDER

30.01.2024 Heard Mr. R.A. Choudhury, learned counsel for the applicants and also heard Mr. Page No.# 2/2 B.B. Gogoi, learned Additional Public Prosecutor, Assam, appearing for the State respondent. This application under Section 438 Cr.P.C. is preferred by two applicants, namely, Pranab Goswami and Rahul Mudiar, who have been apprehending arrest in connection with Gohpur P.S. Case No.140/2023, under Section 34, 420 and 468 of the IPC, for grant of pre-arrest bail. Mr. Gogoi, learned Additional Public Prosecutor submits that though he was asked to produce the case diary before this Court, yet he has received instruction that after completion of investigation, the I.O. has submitted Final Report, being F.R. No.85/2023 dated 30.12.2023. Since after completion of investigation the I.O. has returned the case in F.R., this petition becomes infructuous and accordingly, the same stands closed.
