Pradeep Kumar Das @ Pradip Das v. The State of Assam

ORDER Date : 22.08.2024 Heard Mr. B.D. Konwar, the learned Senior Counsel assisted by Mr. H. Agarwal appearing for the applicant and Mr. K.K. Parasar, the learned Additional P.P. for the State of Assam.

¶2This is an application under Section 438 of the Cr.P.C. praying for grant of pre-arrest bail to the applicant in respect of Bharalumukh P. S. Case No. 0357/2023. Page No.# 2/2

¶3Pursuant to the interim order granted to the petitioner on 12.12.2023, the applicant has appeared before the Investigating Officer. His statements have been recorded. The applicant is a 70 year old person. The Investigating Officer has reported that he had suffered brain stroke and because of his illness and age, he could not remember anything.

¶4This Court is of the opinion that the applicant is co-operating with the Investigating Officer and therefore, he does not deserve to be detained in custody. Therefore, the interim bail granted on 12.12.2023 to the applicant, Pradeep Kumar Das @ Pradip Das is hereby made absolute.

¶5The bail application stands disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
