ORDER

10.01.2024 Heard Mr. A.K. Hussain, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor, appearing for the State of Assam. Page No.# 2/2 Learned counsel for the petitioner has submitted that the present petitioner, namely, Batashi Begum, who is a 55 year old lady and the mother of the main accused, namely, Rakibul Hussain has already been allowed to go on interim bail, by order dated 14.12.2023 by this Court and as per directions of this Court, the petitioner has already appeared before the Investigating Officer and has co-operated in the investigation. On the other hand, learned Additional Public Prosecutor has produced the case diary of Gobardhana P.S. Case No. 179/2023 and has submitted that though there are incriminating materials against the present petitioner of having committed offence under Section 313 of the Indian Penal Code, however, she has already appeared before the Investigating Officer and was allowed to go on interim anticipatory bail as per directions of this Court. Considering the fact that the petitioner has appeared before the Investigating Officer as per directions of this Court and has co-operated in the investigation, the custodial interrogation of the present petitioner does not appear to be necessary for fair completion of the investigation of Gobardhana P.S. Case No. 179/2023. In view of the above, the interim bail granted to the present petitioner, by order dated 14.12.2023 by this Court is hereby made absolute. With the above observation, this anticipatory bail application is hereby disposed of.
