ORDER 31-07-2024 Heard Ms. G. Borah, learned counsel for the applicant and Mr. K. Baishya, learned Additional Public Prosecutor, Assam for the State. By this application, the applicant/petitioner prays for impleadment of respondent Nos. 2 and 3 as party respondent Nos. 2 and 3 in the connected Crl. Rev. P. No. 473/2023, presently pending for disposal stating that the respondent No.2 is the first owner of Bolero Pick Up FB 2WD BSIII Vehicle bearing Registration No. AS-07AC-0913, which was purchased by the respondent No.3 later from the original owner respondent No.2 and submitted the applicant/petitioner by sale agreement dated 24.08.2028 purchased the said Bolero Pickup vehicle from the respondent No.3. It is submitted by the applicant/petitioner that earlier he could not furnish these information before the Court while preferring the connected Crl. Rev. P. No. 473/2023, pending for disposal. After hearing the learned counsels for the parties, considering the entire aspect of the Page No.# 3/3 matter, this Court is of the view that the respondent Nos. 2 and 3 are necessary parties for proper adjudication of the connected Crl. Rev. P. No. 473/2023. Accordingly, this Interlocutory Application is allowed, allowing the applicant to make the respondent Nos. 2 and 3 as party respondent Nos. 2 and 3 in the connected Crl. Rev. P. No. 473/2023 by filing necessary amendment application of the cause title in said Crl. Rev. P. No. 473/2023. Accordingly, this Interlocutory Application, stands disposed of.
