05.02.2024 By this application under Section 438 Cr.P.C., the petitioners namely, Sri Ajit Kataki and Sri Krishna Kataki @ Botali have prayed for granting pre-arrest bail, who is apprehending arrest in connection with Sipajhar Police Station Case No. 313/2023 under Section 325/307/34 IPC. It is submitted by the learned Additional Public Prosecutor for the State of Assam that the charge-sheet being CS No. 494/2023 dated 29.12.2023 has already been filed by the Investigating Officer after completion of the investigation. In that view of the matter, the instant application stands closed. Needless to say that the petitioners shall be at liberty to appear before the learned court below by filing appropriate application seeking regular bail and in the event of filing such petition, the learned court below shall consider the same in accordance with law.
