Judgment

ORDER Date : 12.01.2024

¶1Mr. P. Sharmah, the learned counsel appearing on behalf of the Petitioner submitted that although there is a civil suit pending where there is an injunction order passed but on the basis of sanction so granted by the Respondent Authorities, the Respondent No.7 is raising construction. He however submitted Page No.# 3/3 that there is a status quo order passed by the learned Trial Court. It is the opinion of this Court that the Petitioner would be well advised to approach the Trial Court for appropriate orders, if so advised.

¶2This Court taking into account the facts of the instant case, is not entertaining the instant writ petition. However, the non-entertaining the instant writ petition and the consequential dismissal of the writ petition shall not prejudice the Petitioner in the proceedings before the Trial Court as well as also to file appropriate applications.

¶3In view of the above, the instant writ petition stands disposed of.
