Heard Mr. K.R. Bora, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P, Assam. Page No.# 2/3 This is an application under Section 438 of the Cr.PC, 1973 for granting the privilege of pre-arrest bail to the petitioner, i.e., Gobind Bora, who is apprehending arrested in connection with Chabua P.S. Case No. 06/2022 (GR-49/2022) registered under Sections 120(B)/409/420/468/471 of IPC. It may be mentioned that by Order dated 22.12.2023, this Court granted interim pre-arrest bail to the petitioner subject to conditions. The Case Diary as called for is placed before this Court. Mr. P. Borthakur, learned Addl. P.P submits that the petitioner has appeared before the I.O in terms of the order passed by this Court earlier. He submits that the petitioner's statement has been recorded under Section 161 Cr.PC and the petitioner is co-operating with the investigation. He further submits that there are no adverse materials collected by the I.O against the petitioner. Accordingly, the interim pre-arrest bail granted earlier by this Court vide Order dated 22.12.2023 is hereby made absolute, subject of course to the following conditions:-

(i) That the petitioner shall co-operate with the investigation.

(ii) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; and Page No.# 3/3

(iii) That the petitioner shall refrain from committing any similar offences in future of which he is accused or suspected of commission. With the above observation and direction, the anticipatory bail application stands disposed of. JUDGE Comparing Assistant
