Heard Mr. A.Z. Ahmed, learned counsel for the accused and Mr. R.J. Baruah, learned Addl. Public Prosecutor for the State respondent.

¶2It is to be noted that on 13.02.2024, Mr. A.Z. Ahmed, learned counsel for the accused prayed for according him permission to withdraw this bail Page No.# 2/2 application. But, on that day, the same was not considered as the record of the learned Court below was called for.

¶3Today, the record has been received from the learned Court below and I have perused the same.

¶4Mr. Ahmed, learned counsel for the accused submits that the person who sworn the affidavit in this bail application was not the person who sworn the affidavit and filed bail application before the learned Court below, and that now he has instruction to withdraw this application, and that the mistake so committed was unintentional and that it happened due to miscommunication, and prays for granting him permission to withdraw the same.

¶5Having heard the submission of learned Advocates of both sides and considering the facts and circumstances on record and also considering the record of the learned Court below, this Court deems it appropriate to accord permission to Mr. Ahmed to withdraw this application.

¶6Accordingly, this bail application stands disposed of on withdrawal. JUDGE Comparing Assistant
