¶7The learned Additional Public Prosecutor has submitted that this case is at the fag end of trial. The embargo under Section 37 of the NDPS acts as a fetter to this bail application. Charge sheet has been laid against the petitioners and, thus, they were charged with offence of transportation of commercial quantity of contraband.
¶8Learned Additional Public Prosecutor has submitted to reject the petition.
¶9In reply to the submission of the learned Additional Public Prosecutor, the learned counsel for the petitioners has submitted that there is no incriminating evidence that the contraband was recovered from the possession of the petitioners.
