This Interlocutory Application under Section 5 of the Limitation Act, 1963 has been filed on behalf of the applicants with a prayer to condone the delay of 115 days in filing the connected appeal. Page No.# 3/3 As per office report, neither A/D Card nor "Unserved Notice" in respect of the notice issued to the sole respondent has been received. However, an affidavit has been filed on behalf of the applicants stating that the notice of this Interlocutory Application has personally been served upon the sole respondent. In such circumstances, service of notice upon the sole respondent is treated to be complete. Having heard the learned counsel for the applicants and after going through the contents of the Interlocutory Application, we deem it appropriate to condone the delay of 115 days in filing the connected appeal. Hence, the Interlocutory Application is allowed. The delay of 14 days in filing the connected appeal is condoned. Registry is directed to register the connected appeal and list the same for admission in the month of August, 2024.
