Karuna Kanta Biswas v. The State of Assam

¶1Heard Ms. K. Malakar, learned counsel for the petitioner.

¶2The petitioner, namely, Karuna Kanta Biswas has filed this application under Section 439 Cr.PC with prayer for bail as he is behind bars since 19.07.2023 in Page No.# 2/2 connection with Bongaigaon GRPS Case No. 56/2023 registered u/s 20(b)(ii) C/29 of NDPS Act.

¶3Heard Mr. D.P. Goswami, learned Addl. PP, Assam.

¶4Case Diary is received. Charge-sheet has not been laid against the present petitioner. The petitioner is behind bars for 183 days.

¶5Considering the length of detention, petition is allowed. The petitioner is enlarged on bail of Rs. 1 lac with a suitable surety of like amount to the satisfaction of the learned Trial Court under the conditions that:- i. The petitioner shall refrain from such activities with which he is alleged; ii. the petitioner shall not leave the jurisdiction of the trial Court without prior permission till completion of the trial; and iii. the petitioner shall not tamper with the evidence. On breach of any of the bail conditions, bail order shall stand cancelled. Send back the Case Diary.
