Misbaharul Hoque Choudhury v. The State of Assam

ORDER Date : 19-06-2024 Heard Mr. M. J. Quadir, learned counsel for the petitioner. Also heard Mr. R. R. Kaushik, learned Additional Public Prosecutor for the State. The learned counsel for the petitioner has submitted that the petitioner, namely, Misbaharul Hoque Choudhury was granted interim bail by this Court by order dated 04.01.2024 and in pursuant to the directions of this Court, the Page No.# 2/2 petitioner has appeared before the Investigating Officer and has cooperated in the investigation. On the other hand, learned Additional Public Prosecutor has produced the case diary of Silchar P. S. Case No. 2151/2023 and has submitted that the statement of the petitioner has already been recorded by the Investigating Officer under Section 161 of the Code of Criminal Procedure, 1973. In view of the fact that the petitioner has complied with the directions of this Court and has cooperated in the investigation, the interim bail granted to the petitioner by order dated 04.01.2024 is hereby made absolute with conditions Nos. 1 and 2 attached to the said order remaining intact. With the above observation, this anticipatory bail application is disposed of.
