ORDER Date : 09-12-2023 Both sides are present including the claimants/appellants. The matter is settled between the parties at an amount of Rs. 17,75,457/-(Rupees seventeen lakhs seventy five thousands four hundred and fifty seven) only inclusive of the interest. New India Assurance Co. Ltd agreed to pay the settled amount of Rs. 17,75,457/-(Rupees seventeen lakhs seventy five thousands four hundred and fifty seven) only, subject to deduction of the TDS on the interest amount and providing the tax deduction certificate to the appellants/claimants. The settled amount will be deposited by the appellant before the Registry of this Court within a period of 30(thirty) days from today. Thereafter, Rs. 3,50,000/-( Rupees three lakhs fifty thousand) only shall be released in favour of claimant No. 2 upon due identification by the engaged counsel. Rs. 5,00,000/- (Rupees five lakhs) only shall be fixed deposited in any bank in the name of claimant no. 3 till she attain her majority and balance amount of Rs. 9,25,457/-(nine lakhs twenty five thousand four hundred and fifty seven) only shall be released in favour of claimant no. 1., upon due identification by the engaged counsel. The statutory deposit amount, if any, shall be adjusted. Return the LCR thereafter.
