Dr. Sunder Lal Pareek v. The State of Nagaland

Heard Mr. Sentiyanger, learned counsel for the peti-tioner and Mr. V. Zhimomi, learned P.P. Nagaland. The petitioner Dr. Sunder Lal Pareek has filed this ap-plication under section 438 of Cr.PC with prayer for pre-arrest Page No.# 2/3 bail as he is apprehending arrest in connection with Women PS, Dimapur Case No.02/2024 u/s 498A & 376 IPC. It is submitted at the bar that the petitioner was in a live-in relationship with the informant since 18/1/2023 to the knowledge of family and relatives of both the petitioner and the informant. However, surprisingly on 14/12/2023, the informant lodged an FIR with the Officer-in-Charge, Women PS Dimapur alleging inter alia that she was forcefully sexually abused at Con-naught Place, new Delhi on 18/1/2023. It is also alleged that the petitioner forcefully took custody of a baby from Nikos hospital and the informant was subjected to torture mentally and physi-cally and that the petitioner family also demanded dowry. It is submitted on behalf of the petitioner that the al-legations made against the petitioner is false and the informant is in the habit of making such allegations against other men. I have considered the submissions at the bar. Case Diary was called for and the progress report was forwarded by the I.O. of the case. It is submitted that the investigation has progressed to a considerable entent and the petitioner has co-operated with the investigation. The petitioner was on interim bail by order of this Court dated 12/2/2024. Considering all aspects and considering the fact that the petitioner has co-operated with the investigation, I deem it fit to grant anticipatory bail to the petitioner. I have also consid-ered the submission that the petitioner is willing to co-operate with the investigation. Considering all aspects, the interim order dated 12/2/2024 is hereby made absolute under the same terms and Page No.# 3/3 conditions imposed upon the petitioner by order dated 12/2/2024.
