O R D E R

07.06.2024

The learned counsel appearing on behalf of the petitioner submits upon perusal of the Office Memorandum dated 30.11.2007 that in view of paragraph No.8 of the Office Page No.# 2/2 Memorandum dated 17.09.2015, the petitioner herein would not be entitled to be considered for compassionate appointment. The learned counsel for the petitioner further submits that the scheme for compassionate appointment is the scheme by which the Government being the model employer taking into account that the sole bread earner of the family had expired, grants an opportunity to a member of the family to be appointed to a post so that the family would not be put into distress pursuant to the death of the sole bread earner of the family. He therefore submits that paragraph No.8 of the Office Memorandum dated 17.09.2015 is in violation to the very concept of compassionate appointment. Therefore, the learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition with a liberty to challenge the Office Memorandum dated 17.09.2015.

¶2Taking into account the above, the instant writ petition stands closed on withdrawal.

¶3The petitioner however is granted the liberty to file a fresh writ petition by challenging the Office Memorandum dated 17.09.2015 as well as seeking other consequential benefits.
